TERMS OF USE OF THE WHATSAPP INFORMATION REQUEST SERVICE AND INFORMATION ON DATA PROCESSING
By accepting these terms of use, the user agrees that the application "WhatsApp for Business" (application managed by WhatsApp Ireland Limited) may be used as a channel for requesting information on products and services offered by the ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) (hereinafter the COMPANY). 1) Purpose and scope of application
The purpose of these terms of use is to regulate the relationship between ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) (hereinafter referred to as the COMPANY) and you (hereinafter referred to as the Customer), when using the WhatsApp application as a contact channel so that the COMPANY can provide you with the information requested, in accordance with your consent, in connection with the use of said application.
2) User acceptance
Checking the corresponding box established in the various contact channels of the COMPANY requesting authorisation to contact the Customer via Whatsapp implies unreserved acceptance of these Conditions of Use and Data Processing. The COMPANY declares that both documents are available in the same channels requesting authorisation to contact via WhatsApp.
3) Access and blocking
In order to receive the information requested, the customer must have a device on which the WhatsApp application is installed. It will also be necessary to have access to the Internet and for the WhatsApp application to be linked to the telephone number communicated to us through the corresponding form.
By using the application, the user must also have accepted WhatsApp's conditions of use and privacy policy.
In any case, the Customer will be able to block communications from the COMPANY that he/she may receive on his/her device via WhatsApp, by configuring the application and blocking the telephone number from which he/she receives communications from the COMPANY, as well as by sending a request to the ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) at [email protected]
4) Correct use of the application
The Customer undertakes to use the application and the services in accordance with the law, these Terms of Use and the WhatsApp Terms of Use, and therefore undertakes not to contravene the legislation in force, and not to infringe the rights and interests of third parties.
The Customer undertakes not to provide through the application any data considered to fall within a particular category (such as, for example, health data, biometric data, political affiliation data, etc.).
5) Data protection
1. Responsible for data processing
ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) located at
74-80, rue Roque de Fillol and tax number 402 499 933 00032, will be responsible for the data provided by the Customer when authorising the sending of information via WhatsApp.
2. Purposes
The Customer's data will be processed for the following purposes; (i) to manage the authorisation and acceptance of the Terms of Use, (ii) to be able to contact the Customer via WhatsApp and inform him/her about the programme selected in his/her next two calls, (iii) to process conversation data and carry out the appropriate procedures that the Customer may carry out through this channel. The Customer's data will be processed on the basis of the consent provided by the Customer when authorising us to contact him/her via the said channel and on the basis of the relationship existing between the parties at the time of acceptance of the Terms of Use.
3. Communication of your data
Customer data will not be transferred, sold, rented or made available to any third party in any way, with the exception of service providers ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC), who carry out certain activities for us (such as, for example, the provision of the WhatsApp service), but who will not process the data for their own purposes. Some of these service providers may be located outside the European Union, as set out in section 4 below.
4. International transfers
By using this service, ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) informs you that customer data may be transferred outside the European Union (EU) or the European Economic Area (EEA).
In all cases, we will ensure that such data processing is always protected by appropriate safeguards, which may include (i) EU approved standard clauses, or (ii) third party certifications.

5. Duration of processing
All data provided will be processed for the time necessary to respond to your request and for a maximum period of two subsequent calls regarding the course in which you have expressed interest. After this period, your data may be kept in an anonymous form for statistical or market research purposes, where possible, or duly blocked in order to comply with any legal obligations of ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC).
6. Further information and exercising your rights
You may at any time request further information on the processing of your personal data and exercise your rights of access, rectification, deletion, limitation or portability by contacting ECOLE DES DIRIGEANTS ET CREATEURS D'ENTREPRISES (EDC) at P.O. 6) Applicable law and jurisdiction
The relationship between the COMPANY and the Customer will be governed by current Spanish law and any dispute will be submitted to the Courts of the User's domicile.
The COMPANY will pursue any violation of these Conditions of Use, taking all civil and criminal actions to which it may be entitled by law.
